1. Subject Matter

These Terms govern access and use of the neonatae. platform (the "Service"), operated by the Data Controller (the "Provider"). The Service offers a structured asynchronous communication channel between free-choice pediatricians and parents of children aged 0-36 months.

2. Service Nature - Not a Replacement for the Medical Relationship

The Service is a communication tool. It does not replace pediatric visits, nor does it constitute an emergency-triage system. In a clinical emergency the User must contact 112 (European Emergency Number) or go to the nearest emergency department.

The pediatrician uses the Service within their professional activity as a private practitioner or SSN-contracted family pediatrician. The Provider does not interfere in the doctor-patient relationship: every clinical decision is the sole responsibility of the professional.

3. Account and Access

The User warrants the truthfulness of the data provided and undertakes to keep credentials confidential. Account sharing or third-party use is prohibited. For minor children, processing consent is given by the holder of parental responsibility.

4. Acceptable Use

Prohibited: (a) uploading unlawful, defamatory, or third-party-rights-infringing content; (b) attempting to access other users' data; (c) using the Service for purposes other than ordinary clinical communication; (d) sending emergency communications via the Service without concurrently activating official emergency channels.

5. Fees and Payments

For pediatricians the Service is provided under published pricing plans. The founding pediatricians of the pilot receive a free pilot period, after which the published pricing plans apply. For parents basic access is free; any premium features are indicated at sign-up.

6. Limitation of Liability

The Provider is not liable for damages arising from: (a) clinical decisions taken on the basis of communications via the Service; (b) temporary platform unavailability; (c) User errors. The Provider's liability is limited, except for willful misconduct or gross negligence, to fees paid in the last 12 months.

7. Changes

The Provider may amend these Terms with 30-day prior notice via in-app message or email. Continued use after amendment constitutes acceptance.

8. Governing Law and Jurisdiction

Italian law applies. For consumers, the court of residence or elected domicile has jurisdiction. For other users, the Court of Milan has jurisdiction.
